End User License Agreement (EULA)

IMPORTANT – READ CAREFULLY: This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User,” “you,” or “your”) and the AllyPak team (“we,” “us,” or “our”) for the use of AllyPak (the “Software” or “Service”), including the game client, launcher, and all associated services.

BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.

1. GRANT OF LICENSE

1.1 Limited License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Software on a compatible Windows device
  • Access and use the Software solely for personal, non-commercial entertainment purposes

1.2 License Restrictions

This license does NOT permit you to:

  • Use the Software for commercial purposes
  • Distribute, sublicense, rent, lease, or lend the Software
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code
  • Modify, adapt, translate, or create derivative works based on the Software
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Use the Software in any way that violates applicable laws or regulations
  • Circumvent or disable any security features or anti-cheat measures

2. SOFTWARE DESCRIPTION & REQUIREMENTS

2.1 System Requirements

Minimum Specifications:

  • Operating System: Windows 10 64-bit or later
  • Processor: Equivalent to systems capable of running Fortnite in mid-2019
  • Graphics: DirectX 11 compatible graphics card
  • Memory: As required by Fortnite mid-2019 specifications
  • Storage: Sufficient space for installation and updates

2.2 Platform

The Software is designed for Windows operating systems. We do not guarantee functionality on other platforms.

3. INTELLECTUAL PROPERTY

3.1 Ownership

The Software, including all content, code, modifications, and derivative works, is owned by AllyPak and is protected by copyright, trademark, and other intellectual property laws.

3.2 Epic Games Assets

Fortnite, including all associated Fortnite game assets, characters, logos, and trademarks, is owned exclusively by Epic Games, Inc. This Software is a fan project and is not affiliated with, endorsed by, or associated with Epic Games, Inc.

3.3 Restrictions

You acknowledge that:

  • You have no ownership rights in the Software
  • You may not claim ownership of Epic Games assets
  • All rights not expressly granted are reserved by AllyPak

4. ANTI-CHEAT & SECURITY

4.1 Anti-Cheat Software

The Software includes anti-cheat measures to ensure fair gameplay. By using the Software, you consent to:

  • Installation of anti-cheat drivers and software
  • Monitoring of system processes and memory
  • Collection of hardware identifiers (HWID) for ban enforcement

4.2 Prohibited Software

You may not use:

  • Cheats, hacks, aimbots, wallhacks, or similar unauthorized software
  • Memory editing or packet editing tools
  • Any software designed to gain unfair advantages
  • VPNs or proxies to circumvent bans or restrictions

4.3 Violations

Violations may result in:

  • Immediate account termination
  • Permanent ban from the Service
  • Hardware (HWID) ban
  • IP ban
  • Legal action in severe cases

5. ACCOUNT & REGISTRATION

5.1 Account Creation

To use the Software, you must:

  • Create an account with accurate information
  • Be at least 13 years of age
  • Have permission from a parent or guardian if under 18

5.2 Account Security

You are responsible for:

  • Maintaining confidentiality of your account credentials
  • All activities under your account
  • Not sharing your account with others

5.3 Account Termination

We reserve the right to terminate accounts that:

  • Violate this Agreement
  • Engage in cheating or exploits
  • Create negative community impact

6. USER GENERATED CONTENT

6.1 Your Content

You may create or share content while using the Software (“User Content”). You retain ownership of your User Content but grant us a license to use it.

6.2 Prohibited Content

User Content must not:

  • Infringe on intellectual property rights
  • Contain malicious code or viruses
  • Harass, threaten, or defame others
  • Violate applicable laws

6.3 Moderation

We reserve the right to remove or restrict access to User Content at our discretion.

7. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SOFTWARE
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR ALTERATION OF YOUR DATA

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SOFTWARE.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AllyPak and its contributors from any claims, damages, losses, or expenses arising from:

  • Your violation of this Agreement
  • Your User Content
  • Your use of the Software

10. MODIFICATIONS

10.1 Software Updates

We may update, modify, or replace the Software at any time. Updates may be automatic or require manual installation.

10.2 Terms Changes

We may modify this Agreement at any time. Continued use after modifications constitutes acceptance.

11. TERMINATION

11.1 Termination by You

You may terminate this Agreement by stopping use of the Software and deleting all copies.

11.2 Termination by Us

We may terminate this Agreement immediately if you:

  • Violate any term of this Agreement
  • Engage in prohibited conduct
  • Fail to comply with anti-cheat measures

11.3 Effects of Termination

Upon termination:

  • Your license to use the Software ends
  • You must delete all copies
  • Provisions regarding intellectual property, disclaimers, and limitations of liability survive

12. GOVERNING LAW

This Agreement shall be governed by the laws of Delaware, without regard to conflict of law principles.

13. DISPUTE RESOLUTION

13.1 Informal Resolution

Before filing a lawsuit, parties agree to attempt informal resolution for at least 30 days.

13.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration under American Arbitration Association rules.

13.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations.

14. MISCELLANEOUS

14.1 Entire Agreement

This Agreement constitutes the entire agreement between you and AllyPak.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Failure to enforce any provision does not waive that provision.

14.4 Third-Party Beneficiaries

There are no third-party beneficiaries to this Agreement.
