Terms of Service

By accessing or using AllyPak (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the AllyPak team (“we,” “us,” or “our”). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

AllyPak is a community-created modification built upon an earlier version of Fortnite. The Service provides a nostalgic experience of older Fortnite builds while introducing original content. The Service is provided for entertainment purposes and is not affiliated with, endorsed by, or associated with Epic Games, Inc.

3. Age Restrictions

3.1 Minimum Age Requirement

You must be at least 13 years of age to use the Service. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the Service, and your parent or guardian must agree to these Terms on your behalf.

3.2 Parental Consent

By allowing a minor to use the Service, the parent or guardian agrees to:

  • Supervise the minor’s use of the Service
  • Accept full responsibility for the minor’s actions and any violations of these Terms
  • Be bound by these Terms as if they were the user

3.3 Age Verification

We reserve the right to request proof of age or parental consent at any time. Failure to provide such proof may result in account suspension or termination.

3.4 Compliance with Children’s Privacy Laws

We comply with applicable children’s privacy laws, including the Children’s Online Privacy Protection Act (COPPA) in the United States. We do not knowingly collect personal information from children under 13 without parental consent.

4. Intellectual Property & Third-Party Rights

4.1 Epic Games Ownership

Fortnite, including all associated trademarks, logos, characters, game assets, and intellectual property, is owned exclusively by Epic Games, Inc. (“Epic Games”). We claim no ownership over any Epic Games intellectual property.

4.2 Fan Project Status

AllyPak is an unofficial, fan-created modification and is not affiliated with, endorsed by, sponsored by, or associated with Epic Games, Inc. in any way. This is a community project created by fans for fans.

4.3 Epic Games’ Rights

Epic Games retains all rights to their intellectual property. Epic Games may request that we cease operations or modify the Service at any time, and we will comply with such requests. Your use of the Service does not grant you any rights to Epic Games’ intellectual property.

4.4 Our Modifications

While Epic Games owns the underlying Fortnite content, we retain rights to:

  • Original code, modifications, and features we develop
  • Our branding, name, and logo (distinct from Epic Games’ marks)
  • Our website, documentation, and original creative content

4.5 User License

By using the Service, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

4.6 Restrictions

You may not:

  • Use the Service for commercial purposes without written permission
  • Use Epic Games’ trademarks or intellectual property in a way that suggests endorsement
  • Redistribute, sell, or profit from the Service or any of its components
  • Remove or alter any copyright, trademark, or proprietary notices

4.7 Copyright Infringement

If you believe any content in the Service infringes your intellectual property rights, please contact us at [email protected] with:

  • Description of the copyrighted work
  • Location of the infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

4.8 Disclaimer of Endorsement

Nothing in these Terms or the Service should be construed as Epic Games endorsing, supporting, or being involved with this project in any way.

5. Prohibited Conduct

You agree that you will NOT:

5.1 Cheating & Unfair Advantages

  • Use, develop, distribute, or advertise cheats, hacks, aimbots, wallhacks, or any unauthorized third-party software that provides unfair advantages
  • Modify game files, memory, or code to gain competitive advantages
  • Use macros, scripts, or automation tools that provide gameplay advantages
  • Exploit bugs, glitches, or unintended game mechanics for personal gain

5.2 Exploits & Game Integrity

  • Intentionally exploit any bugs, errors, or design flaws in the Service
  • Abuse game mechanics in ways not intended by the developers
  • Duplicate items, currency, or other game elements through exploits
  • Share, distribute, or publicize exploits or vulnerabilities

5.3 Account Misconduct

  • Share, sell, trade, or transfer your account to others
  • Use multiple accounts to circumvent restrictions or bans
  • Impersonate other users, moderators, or staff members
  • Access or attempt to access accounts that do not belong to you

5.4 Disruptive Behavior

  • Harass, threaten, abuse, or harm other users
  • Use hate speech, discriminatory language, or engage in bullying
  • Spam, flood, or disrupt gameplay or communications
  • Intentionally sabotage teammates or engage in griefing
  • Promote or engage in illegal activities

5.5 Technical Interference

  • Attempt to gain unauthorized access to our systems, servers, or infrastructure
  • Launch denial-of-service attacks or similar disruptive activities
  • Reverse engineer, decompile, or disassemble the Service (except where prohibited by law)
  • Distribute malware, viruses, or harmful code

6. Enforcement & Bans

6.1 Our Rights

We reserve the right to:

  • Suspend, terminate, or ban any account at any time, for any reason or no reason, with or without notice
  • Remove, modify, or restrict access to any content or features
  • Investigate suspected violations of these Terms
  • Cooperate with law enforcement regarding illegal activities

6.2 Enforcement Actions

Violations may result in:

  • Warnings
  • Temporary suspensions
  • Permanent bans
  • IP bans
  • Hardware bans
  • Legal action in severe cases

6.3 No Obligation to Explain

We are not obligated to provide specific reasons for enforcement actions, though we may choose to do so at our discretion.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Termination

You may stop using the Service at any time. We may terminate or suspend your access immediately for any violation of these Terms or for any other reason at our sole discretion.

11. Governing Law

These Terms shall be governed by the laws of Delaware, without regard to conflict of law principles.
